Terms and Conditions (T&C)
Last updated: 8 October 2026 (version 2026-10-08)
These Terms and Conditions govern the use of the Ride-Share platform.
1. Scope
The T&C apply to all users who use the platform to arrange rides.
2. Platform services
Ride-Share is a pure intermediary platform and only provides the technical infrastructure through which drivers and passengers find each other. Ride-Share is not a transport company, does not provide any transport services itself and does not become a party to the carpooling agreement. That agreement is concluded exclusively between the persons involved, who alone are responsible for its performance.
3. Obligations of users
Users are obliged to provide truthful information and not to use the platform in an abusive or unlawful manner. Drivers warrant that they hold a valid driving licence, that the vehicle is registered, roadworthy and covered by compulsory motor vehicle liability insurance (Art. 63 of the Swiss Road Traffic Act, SVG), and that they comply with road traffic law. Rides are private carpooling: the price charged must not exceed the pro-rata costs of the ride; commercial or professional passenger transport via the platform is prohibited. Ride-Share may suspend the accounts of users who breach these T&C, in particular when drivers fail to carry out booked rides without cancelling them.
4. Liability
Ride-Share acts solely as an intermediary platform and – to the extent permitted by law – accepts no liability whatsoever in connection with the rides arranged through it. In particular, Ride-Share is not liable for the performance, punctuality, safety or quality of rides, the conduct of users, the accuracy of user information (e.g. vehicle or driving licence details), accidents, personal injury, damage to property or financial loss, delays, cancellations, drivers or passengers not showing up, or lost items. Participation in rides is at the users' own risk; claims must be pursued directly between the persons involved. The refunds under sections 5 and 6 remain reserved; any further claims, e.g. for a replacement ticket, must be pursued directly against the driver. Claims arising from accidents are governed by the Swiss Road Traffic Act (SVG) and are directed against the vehicle keeper or driver and their compulsory motor vehicle liability insurance (Art. 63 SVG); drivers are solely responsible for maintaining this insurance cover. Mandatory statutory liability, in particular for damage caused by Ride-Share's own intent or gross negligence (Art. 100 of the Swiss Code of Obligations), remains reserved.
5. Payment and cancellation
When a ride is booked, the total amount (fare + service fee, which also covers the payment processing costs) is processed as follows:
- TWINT: The full amount is charged at booking via the TWINT app (processed through Stripe). The driver's share of the fare is only paid out once the ride has been completed.
- Credit card: The full amount is charged at booking. The driver's share of the fare is only paid out once the ride has been completed.
Cancellation: Passengers may cancel a booking at any time. Drivers may cancel a ride without passengers at any time, otherwise up to 8 hours before departure.
- Credit card: The service fee is not refunded when a passenger cancels. If cancelled more than 5 hours before departure, the fare is refunded in full; within 5 hours of departure, an additional 20% of the fare is retained. If the driver cancels the ride, the full amount is refunded, including the service fee.
- TWINT: Cancellations of TWINT payments are refunded under the same conditions as credit card payments.
6. Payout to drivers
Drivers choose their payout method in their profile. Passengers always pay the same service fee; the payout to the driver depends on the chosen method:
- Stripe: After the ride is completed, 95% of the fare is credited automatically via Stripe Connect to the driver’s Stripe account (Ride-Share retains 5%). Stripe pays the balance out daily to the registered bank account once it reaches at least CHF 5; smaller amounts stay in the Stripe account until then. On request, Ride-Share pays out balances below CHF 5 by TWINT or bank transfer; the share of the respective payout method then applies (TWINT 85%, bank transfer 80% of the fare).
- TWINT: 85% of the fare is transferred to the driver manually by the operator to their TWINT phone number (Ride-Share retains 15% for the manual handling).
- Bank account: 80% of the fare is transferred to the driver's IBAN manually by the operator (Ride-Share retains 20% for the manual handling).
Completing the ride: passengers complete the ride after arrival by rating it. If they don't, the ride counts as completed 48 hours after the planned arrival, and the payout is triggered. A passenger who reports a problem within those 48 hours via 'Report a problem' (e.g. because the ride didn't take place) puts the payout for their booking on hold. Ride-Share reviews the report and either pays the fare share to the driver or refunds the passenger the full amount, service fee included.
7. Receipt
For each booking, a receipt with a sequential number is created and attached to the booking confirmation as a PDF. The fare is a private cost-sharing contribution between passengers; the service fee is the consideration for using the Ride-Share platform, payment processing included.
8. Verification and safety
For the safety of all users, offering and booking rides may require a confirmed email address and a phone number verified by SMS. Users are obliged to provide accurate information (including vehicle data). Offering rides additionally requires a payout method stored in the profile.
9. Ride preferences
Drivers can set preferences (e.g. pets, smoking, music, “Comfort: max. 2 in the back” as well as “Women-only”). “Women-only” rides may be offered exclusively by female drivers and booked only by women; this requires the gender to be stated in the profile. Bookings that conflict with a preference may be declined.
10. Changes
Ride-Share may amend these T&C. Amendments are published on the platform before they take effect. Each booking is governed by the version accepted at the time of booking; the accepted version is recorded. Users who do not agree with an amendment may stop using the platform and delete their account at any time.
11. Governing law and place of jurisdiction
Swiss law applies, to the exclusion of its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered seat of the operator. Mandatory statutory forums, in particular the forum for consumer contracts under Art. 32 of the Swiss Civil Procedure Code (CPC), remain reserved.
12. Severability
Should individual provisions of these T&C be or become wholly or partially invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid one.
